This promotion (“Anthony Bourdain’s Medium Raw Challenge Contest") is sponsored by HarperCollins Publishers ("HarperCollins"), 10 East 53rd Street, New York, New York, 10022.

 

ELIGIBILITY

 

NO PURCHASE NECESSARY. To enter, go to www.bourdainmediumraw.com, complete the registration form and submit your essay. Essays may not exceed 500 words. You will also be required to submit a description of your essay of no more than 35 words, but the entries will be judged on the essays alone.

 

The Contest is open to all legal residents of the United States, 18 years of age and older by 07/06/2010, excluding employees and immediate family members of HarperCollins, and its parents, subsidiaries, affiliates, assigns, advertising, promotional and fulfillment agents, attorneys, and other representatives and the persons with whom each of the above are domiciled. Offer void outside the United States and wherever prohibited or restricted by law.

 

Each entrant in the Contest must be the rightful owner or have authorized use of the e-mail account indicated by the entrant's e-mail address. In the event of a dispute concerning the identity of the winner submitting an entry, the winner will be deemed to be the person in whose name the e-mail account is opened. The e-mail account must be opened prior to 9:00 a.m. (EST) on 07/06/2010.

 

ENTRY PERIOD

 

The Contest will commence on 07/06/2010 (9 a.m. EST). The last entry will be accepted on 09/30/2010 (5:00 p.m. EST). During this time period, registered users will be able to vote for essays. Users may vote for an essay once a day. The entrants may not vote for their own essays.

 

SELECTION AND NOTIFICATION OF WINNERS

 

Winners of the preliminary round will be selected by a committee of editors from HarperCollins. All entries submitted in accordance with the Official Rules will be read by the committee. The preliminary round will be judged on the following criteria: (i) creativity (30%), (ii) originality (30%), (iii) writing style (30%) ten percent (10%) will be determined by the voting of visitors to the Website. Based on these criteria, ten finalists will be selected. The ten finalist selections will be read by Anthony Bourdain, who will select one essay as the final contest winner. The criteria for the final winner will be based upon which essay Anthony Bourdain decides best answers the question “What does it mean to cook food well?” The final contest winner will have his/her essay printed in the paperback edition of “Medium Raw” by Anthony Bourdain. Harper Collins reserves the right to edit the winning essay with the collaboration and cooperation of the winner before publication. The other nine runner-ups will received a signed hardcover copy of the book “Medium Raw” by Anthony Bourdain. Winners will be chosen on or about 11/01/2010. All potential winners will be notified by e-mail. Potential winners may be required to sign and return to HarperCollins an affidavit of eligibility and release of liability (the "Affidavit"), and, if the Affidavit is not returned within 14 days of notification, the potential winner will be deemed to have forfeited the prize, and an alternate potential winner will be chosen.

 

PRIZES

 

One grand prize winner’s essay will be published in the paperback edition of “Medium Raw” by Anthony Bourdain, to be published in 2011. This prize has no cash value. The remaining finalists of the preliminary selection round (nine total) will received a signed first edition of the hardcover book “Medium Raw” by Anthony Bourdain. Estimated retail value: $26.99 each. Total estimated retail value of all prizing: $250.00.

 

Only one prize will be awarded per individual, family, or household. All prizes are non-transferable and cannot be sold or redeemed for cash. HarperCollins may substitute a cash payment of equal or greater value for the runner up prizes. Any federal, state, local, or provincial taxes are the sole responsibility of the winners.

 

CONDITIONS

 

 By participating, entrants signify their acceptance of the Official Rules and decisions of the judges, which will be final in all respects, and to waive any claim with respect to ambiguity of the Official rules. By participating, Entrants grant to Sponsor a royalty-free, non-exclusive, perpetual, worldwide license to publish the essay in all editions of Anthony Bourdain’s book MEDIUM RAW in any and all media now known and hereafter devised, including electronic media and over the Internet, and the right to use winner’s first name, age, and address (limited to city and state) in any and all media and for publicity purposes without further compensation except where prohibited by law.

Entrants release, discharge, and hold harmless HarperCollins, its parent, affiliates, subsidiaries, and assigns, and their respective employees, attorneys, representatives and agents, including advertising, promotion and fulfillment agencies, from any and all liability or damages arising from the administration of the Contestand the use or misuse of any prize received in the Contest, including, without limitation, the following: (i) late, lost, incomplete, delayed, misdirected or unintelligible entries, (ii) any printing, typographical, administrative or technological errors in any materials associated with the Contest, including, without limitation, entry materials and prize notifications, and (iii) any damage to the entrant's computer and related equipment and software resulting from entrant's downloading of information regarding the Contest or participation in the Contest. Entry materials and prize notifications that have been tampered with, altered, or do not comply with these Official Rules are void. HarperCollins may only use the personally identifiable information obtained from the entrants in accordance with these Rules and its privacy policy.

 

HarperCollins reserves the right, in its sole discretion, to modify, cancel or suspend this Contest should a virus, bug, computer problem or other causes beyond its control corrupt the administration, security or proper operation of the Contest. HarperCollins may prohibit you from participating in the Contest or winning a prize if, in its sole discretion, it determines that you are attempting to undermine the legitimate operation of the Contest by cheating, hacking or employing other unfair practices or by abusing other entrants or the representatives of HarperCollins.

 

ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND, IN SUCH EVENT, HARPERCOLLINS RESERVES THE RIGHT TO PURSUE THEIR REMEDIES AND DAMAGES (INCLUDING COSTS AND ATTORNEY'S FEES) TO THE FULLEST EXTENT OF THE LAW.

 Odds of winning depend upon the nature, quality and number of eligible entries.

Any dispute arising from the Contest will be determined according to the laws of the State of New York, without reference to its conflict of laws principles, and the entrants consent to the personal jurisdiction of the State and Federal Courts located in the State and County of New York over them and agree that such courts have exclusive jurisdiction over all such disputes.
